The X Corp Trademark Case — The Story

In October 2023, Elon Musk rebranded Twitter as X. Jacob Malherbe's company — X Social Media, LLC, founded in Winter Garden, Florida in 2015 — held a federal trademark registration for "X SOCIAL MEDIA" (registered 2016) in advertising and marketing services. Before filing suit, Jacob sent X Corp a cease-and-desist letter demanding they stop using the mark. Receiving no satisfactory response, X Social Media filed suit in the United States District Court for the Middle District of Florida.

The complaint asserted violations of Sections 32 and 43(a) of the Lanham Act (15 U.S.C. §§ 1114 and 1125) — trademark infringement, false designation of origin, common law unfair competition, and dilution under Florida statutes. The core allegation: consumer confusion in the legal marketing sector where law firms might mistakenly associate X Social Media's specialized services with X Corp's platform, causing irreparable harm to brand identity and lost business opportunities.

X Corp moved to dismiss in late 2023, calling it a "shakedown." In July 2024, U.S. District Judge John Antoon II denied the bulk of the motion — ruling that X Social Media had sufficiently alleged trademark infringement and unfair competition, including evidence of consumer confusion and irreparable harm. The case advanced to discovery into 2025.

On September 15, 2025, X Corp settled. Settlement terms are confidential. As part of the resolution, X Social Media was required to cease using the "X" name.
